Miley Cyrus could face a jail sentence after being spanked on stage with a Mexican flag.

The 21-year-old star – known for her controversial on-stage antics – has caused controversy after one of her dancers jokingly smacked the prosthetic butt she was sporting with the symbolic piece of fabric during her show in Monterrey, Mexico on Tuesday night.

According to gossip website TMZ, Miley could be in trouble because of the incident as the congress of the state of Nuevo Leon allegedly wants to take action against the pop star.

Should they be successful then the 'Wrecking Ball' hitmaker could face 36 hours in jail or a fine of $1,200.

It's not the first time Miley has come under fire for her on-stage antics. She was slammed for her performance with Robin Thicke at the 2013 MTV Video Music Awards when she stripped down to a flesh-coloured latex bikini, twerked up against his body and touched his crouch with a foam finger.

Should Miley get into trouble for her latest antics then she wouldn't be the only star to face the wrath of the Mexican authorities.

In 2008, Paulina Rubio was fined $4,000 after she appeared naked while draped in a Mexican flag in the Spanish edition of Cosmopolitan.

Her mother, Susana Dosamantes, shot to her Mexican daughter's defence insisting she didn't authorise the publication to publish the pictures.

She said at the time: "I'm not sure if the photo has been doctored, but I do know that there's a studio that took [some photos] of Paulina seven years ago that she didn't authorise to be published.

"If you look at the picture, you'll realise that it's not current, or real."
